INA § 212(a)(7)(A)(i)(I)
Status: Current
Summary
A documentation-based ground of inadmissibility applying to immigrants seeking admission to the United States without the documents required for lawful admission.
This provision belongs to INA § 212, the statutory collection of grounds of inadmissibility, rather than INA § 237's grounds of deportability. The INA-to-U.S.-Code correspondence is: INA § 212 = 8 U.S.C. § 1182. Thus INA § 212(a)(7)(A)(i)(I) appears at 8 U.S.C. § 1182(a)(7)(A)(i)(I).
Holding
Except as otherwise provided by law, an immigrant applying for admission who does not possess the required valid, unexpired immigrant visa, reentry permit, border crossing identification card, or other required entry document, together with any required valid passport or other suitable travel or identity document, is inadmissible.
Topics: inadmissibility, entry documents, immigrant visa, admission

Notes
The NTA review colloquy that IJs give regarding this charge is often formulated as follows: 'the Department (or Government) also alleges at the moment that you arrived/crossed the border/requested permission to enter/applied for admission to the United States, you were not then in possession of a valid, unexpired immigrant visa, re-entry permit, border crossing card, or other valid entry/immigration document as required by law. Is that true?'
