One of the basic statutory grounds of deportability, in the old days, or what we now call removability. Section 237(a)(1)(B) applies to a person who is present in the United States in violation of immigration law or other federal law, including circumstances in which a person lawfully entered but no longer has authorization to remain.

Holding

Topics: deportability, removability, immigration status, overstay

Related terms: deportable, removable, overstay, arriving alien, EWI

Notes

INA § 237 generally concerns grounds of deportability applicable after admission, in contrast with INA § 212, which contains grounds of inadmissibility.
