Comments:"Intending immigrant means any beneficiary of an immigrant visa petition filed under section 204 of the Act, including any alien who will accompany or follow-to-join the principal beneficiary." 8 CFR § 213a.1 - Definitions. This term can be used both to describe a beneficiary of an immigrant visa (makes sense), as well as the beneficiary of a nonimmigrant visa who, the Government believes, has the intention to immigrate (permanently) to the United States, despite not having the right visa to do so.
