Comments:The normal expression used by interpreters here in the US is something like 'a discreción fiscal' or 'a discreción del fiscal'; Spanish terms these abilities broadly as 'facultad(es) discrecional(es)' (Ossorio), or even 'discrecionalidad' (Principios de obligatoriedad y discrecionalidad en el ejercicio de la acción penal, Manuel Rodriguez Vega); usage of 'poder discrecional' appears often in translated texts. In all of these cases, the discretionality in question is that of the criminal prosecutor. As discussed elsewhere in the present resource (see Trial Attorney), DHS attorneys should not be considered an exact corollary of a criminal prosecutor. Therefore, to avoid referring, even elliptically, to DHS as a 'fiscal', other options are recommended.
